Non-disclosure Agreement?
I recently created an account on Odesk which is an online marketplace for Freelance Programmers. My only concern is whether or not my ideas will be protected from theft. While I have obtained an NDA (Non-disclosure agreement). Many of the contractors are overseas, and based on my legal understanding both parties need to sign the document in the presence of each other and possibly on the same date. Is there a way for a person to sign an NDA from far away that is legally binding, for example an online form or faxing? I know that dealing with overseas courts would be a hassle but at the very least I want some measure of deterrent.
A signed document is valid even if the parties don’t meet face to face and sign on different days. It happens in the business world all the time. There is no way company executives are going to fly out every time they need to sign a contract with another company.
But it depends on the country. Some countries may have legal systems that make it very difficult for foreigners to enforce contracts.
